Настоящий документ является официальным предложением (публичной офертой) ИП «Доржыбаев» (далее «Исполнитель») заключить договор на оказание услуг по предоставлению доступа к программному обеспечению WabaFlow на изложенных ниже условиях.

1 Предмет договора

1.1. Исполнитель предоставляет Заказчику право использования платформы WabaFlow для подключения номера WhatsApp Business, отправки и приёма сообщений, рассылок, автоматизации и ведения переписки с клиентами в формате SaaS.

1.2. Сервис использует официальную интеграцию с WhatsApp Business Platform компании Meta Platforms, Inc.

2 Акцепт оферты

2.1. Акцептом настоящей Оферты является регистрация Заказчика на сайте WabaFlow и/или внесение оплаты.

2.2. С момента акцепта договор считается заключённым.

3 Оплата и доступ

3.1. Стоимость услуг и тарифные планы указаны в личном кабинете Заказчика.

3.2. Отправка сообщений через WhatsApp Business Platform может тарифицироваться компанией Meta отдельно, в соответствии с её правилами.

3.3. Доступ к сервису предоставляется на срок оплаченного периода.

4 Права и обязанности

• Исполнитель обеспечивает работоспособность сервиса и техническую поддержку.
• Заказчик обязуется использовать сервис в соответствии с правилами WhatsApp Business и применимым законодательством.
• Заказчик несёт ответственность за содержание отправляемых сообщений и согласие получателей на их получение.

5 Ограничение ответственности

5.1. Исполнитель не несёт ответственности за ограничения, блокировки или изменения правил со стороны Meta Platforms, Inc.

5.2. Сервис предоставляется на условиях «как есть».

Terms of Service

Effective date: May 28, 2026

This document is the official offer (public offer) of IE "Dorzhybayev" (hereinafter the "Provider") to enter into an agreement for providing access to the WabaFlow software on the terms set out below.

1 Subject of the agreement

1.1. The Provider grants the Customer the right to use the WabaFlow platform for connecting a WhatsApp Business number, sending and receiving messages, running broadcasts, automation and conducting customer correspondence as a SaaS service.

1.2. The service uses the official integration with the WhatsApp Business Platform of Meta Platforms, Inc.

2 Acceptance of the offer

2.1. Registration on the WabaFlow website and/or payment by the Customer constitutes acceptance of this Offer.

2.2. The agreement is considered concluded from the moment of acceptance.

3 Payment and access

3.1. The cost of services and pricing plans is indicated in the Customer's dashboard.

3.2. Sending messages via the WhatsApp Business Platform may be charged separately by Meta under its own pricing rules.

3.3. Access to the service is granted for the duration of the paid period.

4 Rights and obligations

• The Provider maintains service availability and provides technical support.
• The Customer undertakes to use the service in accordance with WhatsApp Business rules and applicable law.
• The Customer is responsible for the content of messages sent and for the recipients' consent to receive them.

5 Limitation of liability

5.1. The Provider is not liable for restrictions, blocks or rule changes imposed by Meta Platforms, Inc.

5.2. The service is provided on an "as is" basis.
